These Terms of Use govern access to and use of the website astyliving.com, as well as the framework for the provision of the services presented or provided through it.

For the purposes of these Terms, ATHENEAN AGENCY Μονοπρόσωπη Ι.Κ.Ε. is referred to as “Asty Living”, the “Company”, “we” or “us”.


1. Scope of the services

Asty Living operates in the real estate sector and provides and/or promotes services relating, among other things, to:
  • short-term rental of and stays in residences
  • property management and development
  • residential rentals
  • presentation and promotion of properties for sale
  • information, communication and intermediation services between interested parties and owners or other holders of rights in properties.
The website may be used to present properties, search for available accommodation or residences, submit enquiries, contact Asty Living and, where available, make a short-term stay booking.
The services and functionalities provided through the website may be changed or expanded.


2. Acceptance of the Terms

By accessing, browsing or using the website, the user declares that they have read and accept these Terms of Use.
If the user does not agree with the Terms, they must not use the website or the related services.
Additional specific terms may apply to particular services; these are communicated to the interested party before the completion of the relevant transaction or contract.
In the event of a conflict between these general Terms and a specific written contract concluded between the parties, the specific terms of the contract shall prevail, to the extent permitted by applicable law.


3. Use of the website

The user agrees to use the website solely for lawful purposes and in accordance with applicable Greek and European law.
The following are prohibited, by way of example:
  • use of the website for unlawful activities
  • the provision of false or misleading information
  • any attempt to gain unauthorised access to systems or data
  • the introduction of malicious software or other harmful code
  • interference with the proper functioning of the website
  • automated collection of data from the website without prior written permission
  • copying, reproduction or commercial exploitation of Asty Living content without permission.
Asty Living reserves the right to restrict or terminate a user’s access to the website in the event of a breach of these Terms or of applicable law.


4. Property information and content

Asty Living makes reasonable efforts to ensure that the information about properties displayed on the website is accurate and up to date.
This information may include:
  • photographs
  • descriptions
  • property features
  • location
  • amenities
  • availability
  • prices
  • floor areas and other details.
However, information about a property may be changed, corrected or updated without prior notice.
Photographs and depictions are used to present the properties and may not fully reflect the actual condition, lighting, dimensions or appearance of a space at the time of a visit or stay.
Before entering into any contract, the interested party must verify the details that are material to their decision.


5. Short-term stays – BnB

Asty Living may offer properties for short-term stays through the website.
Specific terms may apply to each property regarding:
  • the price
  • the dates of stay
  • the number of guests
  • check-in and check-out times
  • the cancellation policy
  • any security deposit
  • pets
  • smoking
  • use of specific areas or facilities
  • other house rules of the property.
These specific terms are communicated to the guest during the booking process or before the completion of the relevant transaction.
Asty Living manages bookings in accordance with the details and terms applicable to each specific property.


6. Bookings and confirmation

Submitting a booking request does not automatically constitute a completed booking, unless this is expressly stated in the relevant process.
A booking is deemed confirmed once the prescribed process has been completed and the customer has received a relevant confirmation.
The confirmation may be sent electronically to the e-mail address provided by the customer.
Asty Living reserves the right to contact the customer to confirm details necessary for the completion or proper performance of the booking.


7. Prices and online payments

 

 

For short-term stay services, where online payment through the website is available, the final price and the available payment methods are displayed before the booking is completed.
Asty Living may use third-party payment service providers.
Card details or other sensitive payment data are not stored by Asty Living, unless this is lawfully provided for and required for the provision of a specific service.
For property sales and purchases and long-term rentals, the financial transaction is not carried out through the website, unless a different option is expressly made available in the future.
The financial terms, deposits, security deposits, rents, purchase price and other financial obligations are determined by the specific agreement or contract concluded between the parties involved.


8. Cancellations and changes to bookings

The terms for cancelling or changing a booking are determined by the policy applicable to the specific property, which is displayed before or during the booking process.
In the event of a cancellation, refund or charge of an amount, the specific terms communicated to the customer at the time of booking shall apply, subject to the mandatory provisions of applicable law.
The possibility of cancellation and refund may vary depending on the property, the dates and the booking policy selected.


9. Residential rentals

Asty Living may present properties available for rent in Attica.
The listing of a property on the website is a means of informing and communicating with interested parties and does not mean that the property will remain available until a relevant contract is signed.
The final lease is concluded upon the execution of the corresponding lease agreement or other written agreement between the parties involved.
The specific terms of the lease, including, by way of example, the rent, the security deposit, the duration, the obligations of the parties and any other financial or contractual term, are set out in the corresponding contract.


10. Property sales and purchases

Asty Living may present and promote properties available for sale.
The presentation of a property on the website does not in itself constitute a binding offer of sale, nor does it create an obligation on Asty Living or the owner to complete the transaction.
Interested parties may contact Asty Living for further information, a viewing of the property or the further process.
The purchase of a property is completed exclusively through the procedures prescribed by applicable law and the relevant contracts and notarial deeds, where required.
The purchase price, deposits and any other financial obligation are not paid through the website, unless expressly provided otherwise for a specific service.


11. Relationship of AstyLiving with owners and third parties

Depending on the specific service, Asty Living may act as manager, service provider, partner, real estate agent and/or intermediary between interested parties and owners or other holders of rights in properties.
The exact capacity and role of Asty Living in each transaction are determined by the nature of the specific service and, where required, by the relevant contract.
Where a transaction is carried out directly between third parties, the relevant obligations and rights of the parties are determined by the contract between them, without prejudice to any obligations incumbent on Asty Living under applicable law.


12. Stay and property rules

Guests must use the property in accordance with:
  • these Terms
  • the specific rules of the particular property
  • the instructions provided on arrival
  • applicable law.
Use of the property for unlawful activities or for activities that cause significant nuisance, danger or damage to the property or to third parties is prohibited.
The number of guests may not exceed the number declared or permitted for the specific property.


13. Damage to the property

The guest or tenant must use the property with due care.
Where damage is caused through the fault of the guest or of another person for whom the guest is responsible, compensation for the damage may be requested in accordance with applicable law and the specific terms of the booking or contract.
Asty Living may request information from the customer regarding an incident involving damage to, loss of or destruction of property.


14. Pets, smoking and specific rules

Whether pets may be accommodated, smoking and the use of specific areas or facilities are determined separately for each property.
The customer must inform themselves of the specific rules before booking or using the property.
A breach of a specific rule of the property may entail the consequences provided for in the specific terms of the booking or of the corresponding contract.


15. Personal belongings

The guest or tenant is responsible for the safekeeping of their personal belongings.
Asty Living is not liable for the loss or theft of personal belongings, unless otherwise provided by applicable law or the Company’s liability is proven.
If an item left behind in a property is found, Asty Living may contact its owner and agree with them on the method of return.


16. Availability and changes to properties

Asty Living does not guarantee that every property displayed on the website will remain available.
The availability, prices, photographs, features and amenities of the properties may change.
If, for reasons not attributable to the fault of Asty Living, it becomes impossible to provide a service that has already been confirmed, Asty Living will make reasonable efforts to inform the customer and to find a suitable solution, in accordance with the terms of the specific service and applicable law.


17. Compliance with the applicable short-term rental framework

Properties offered for short-term rental are subject to the Greek legislative and regulatory framework in force from time to time.
Where required, properties offered through digital platforms must hold the prescribed Property Registry Number (A.M.A.) and the relevant obligations provided for by law must be complied with.
Asty Living and the owners or managers of the properties must, within the scope of their respective roles and obligations, comply with the applicable regulatory framework.
Short-term rentals are also subject to the specifications and requirements laid down by Greek law in force from time to time.

 

18. Intellectual property

The content of the website, including, by way of example, texts, graphics, logos, photographs, design elements, structure and other material, is subject to intellectual and/or industrial property rights of Asty Living or of third parties who have granted a relevant licence.
Reproduction, copying, modification, distribution, publication or commercial exploitation of the content without prior written permission is prohibited, unless permitted by applicable law.


19. Property photographs and material

 

 

Photographs and other material relating to properties may originate from Asty Living, owners, partners or other lawful sources.
Their use or reproduction by third parties without permission is prohibited where they are protected by intellectual or other property rights.

 


20. Information submitted by users

When a user submits details, requests, comments or other material through the website, they declare that the information they provide is true and that they have the right to submit it.
Asty Living may use this information solely for the purposes for which it was collected and in accordance with the Privacy Policy.


21. Personal data

Personal data are processed in accordance with applicable data protection law, including the General Data Protection Regulation (GDPR).
The required information regarding the data controller, the purposes and legal basis of processing, the recipients, data retention and the rights of data subjects is provided in Asty Living’s separate Privacy Policy.
The use of cookies and similar technologies is governed by the separate Cookie Policy.


22. Communication and electronic messages

The user is responsible for the accuracy of the contact details they provide.
Asty Living may use the contact details provided by the user for:
  • booking confirmation
  • communication regarding a property
  • responding to an enquiry
  • updates regarding a service that has been requested
  • management of a transaction or contract
  • other lawful purposes described in the Privacy Policy.
Commercial communications are sent in accordance with the requirements of applicable law and, where required, with the recipient’s prior consent.


23. Website security

Asty Living makes reasonable efforts to maintain the security and proper functioning of the website.
However, it cannot guarantee that the website will always be available or free from every possible technical error, malicious software or other technical threat.
The user must take appropriate measures to protect their own devices and data.


24. Limitation of liability

Asty Living makes reasonable efforts to ensure the accuracy and availability of the information provided through the website.
However, to the extent permitted by applicable law, Asty Living is not liable for:
  • temporary unavailability of the website
  • technical problems not attributable to its fault
  • third-party information that has changed without prior notice
  • events beyond its reasonable control
  • acts or omissions of third parties, owners, guests or other transacting parties.
Subject to the mandatory consumer protection provisions and any other provision of mandatory law.
Nothing in these Terms limits any liability that Asty Living is not lawfully permitted to limit or exclude.


25. Force majeure

Asty Living is not liable for any inability or delay in performing an obligation where this is due to events beyond its reasonable control, such as, by way of example, natural disasters, fires, extreme weather events, epidemics, armed conflicts, government measures, interruptions of networks or utility services, serious technical failures or other circumstances of force majeure.


26. Breach of the Terms

In the event of a breach of these Terms, Asty Living may, depending on the nature and seriousness of the breach and in accordance with applicable law:
  • request that the breach be remedied
  • restrict the user’s access to the website
  • cancel a service or booking where permitted
  • take the necessary legal measures to protect its rights and interests.


27. Amendment of the Terms

Asty Living may amend these Terms when necessary, among other things due to changes in the services, technology or the applicable legislative framework.
The most recent version will be published on the website.
Amendments do not affect rights and obligations that have already arisen under a valid contract, unless otherwise provided by applicable law.


28. Severability

If any provision of these Terms is held to be invalid, unlawful or unenforceable, such invalidity shall not affect the validity of the remaining provisions.
The provision concerned shall be applied, to the extent permitted by law, in the manner that comes closest to its original purpose.


29. No waiver

Any failure or delay by Asty Living in exercising any right shall not be deemed a waiver of that right.


30. Governing law and dispute resolution

These Terms are governed by Greek law, without prejudice to provisions of mandatory law that grant consumers or other protected persons rights which cannot be excluded by contract.
Any dispute arising from the use of the website or the services of Asty Living shall first be sought to be resolved amicably through communication between the parties.
If an amicable resolution is not possible, the courts designated by applicable law shall have jurisdiction.


31. Privacy and Cookie Policy

These Terms of Use are supplemented by:
  • the Privacy Policy of Asty Living
  • the Cookie Policy of Asty Living.
These documents form an integral part of the framework for informing users about the operation of the website and the processing of their personal data.
